Dear customer, our company, welcome you as our customer and join the long list.
The site and appliance are the company's property and belonging. Supplementary equipment such as the application are company's development, design, and production. The user has the right to act only based on these license rights.
Companies believe in cooperating with their clients, therefore clients are more than welcome to contact the company in any matter.
App requires internet/ Wi-Fi enables controlling company products via internet/ Wi-Fi.
The company R&D constantly is working to improve products and services. The company has the right to change terms of use, user agree to the latest edition. We recommend being updated at this page once in a while.
The use of the products is considered as agree to terms of use (the use).
The terms are valid while the user uses the product's company.
IF YOU DO NOT AGREE TO THESE TERMS OF USE, PLEASE DO NOT USE THIS WEBSITE OR APP OR ANY PRODUCTS RELATED. YOU HAVE THE RIGHT TO ERASE THE PRODUCT FROM YOUR SMARTPHONE DEVICE.
The Service
The Company produce, develop, market, and sell appliance for the smart-home market including other products that enable controlling company products via an app or local control ("products").
The use of the app requires download of the app and sign-up or any other requirements- for controlling the products.
You declare that all details filled in the app are your, correct, and not of a third party. Data is stored in the company's database according to the privacy policy.
User Rights
Users may use the app only for the original use of it- control company products and devices via the app according to guidelines with resendable use of reasonable person.
COMPANY IS NOT RESPONSIBLE BY ANY CIRCUMSTANCES (DIRECT OR INDIRECT OR ANY OTHER) TO THE USE OF THE APP AND ITS EFFECTS ICLUDING NOT RESENAOBE USE.
The license is given to the unique user – the person that downloaded the app and signed up to the app. The license is only for personal use.
Users under the age of 18 required parent's confirmation before signing up or using the app.
The user takes full responsibility for the use of the app and its effects. The company provides the app as bonus and it is not obligatory or a must for controlling company products. The company has the right to stop this service at any time with no pre message. The company provides the app on an as-is basis and won't be responsible in any manner. The user acknowledges the risks and confirm to take full responsibility.
Proper or expected usage of the app
You are not allowed to copy, print, save, or any other way to use the app data or its database or manipulate the data such as scarping, data mining, harvesting, screen scraping, aggregating in any way, indexing, using a robot, spider, scraper, or any other automated technics to the app or any other device related to the company or databases.
The app will be used solely according to what is allowed in these terms of use.
All rights, title, and interest, trademark, or service mark rights in the Service belong to the company (Copyrights, trademarks, industrial designs, patents and trade secrets, products, UX, methods, design, process, technology, code). Terms of use don’t let user copy or modify, adapt, translate, reverse engineer on any part of the app or company products or services. Only if the company gave written approval.
Names, logos, slogans, signs belong to the company, even if didn’t trademarked or patented.
Apple
If you use the Service through an Apple device, then you agree and acknowledge that:
Apple, Inc. bears no duties or obligations to you under the Terms, including, but not limited to, any obligation to furnish you with Service maintenance and support;
You will have no claims, and you waive any and all rights and causes of action against Apple with respect to the Service or the Terms, including, but not limited to claims related to maintenance and support, intellectual property infringement, liability, consumer protection, or regulatory or legal conformance;
Apple and Apple’s subsidiaries are third-party beneficiaries of the Terms. Upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

THE COMPANY IS NOT RESPONSIBLE BY ANY CIRCUMSTANCES TO THE USE OF THE APP AND ITS EFFECTS, (OR ANY OF ITS, AFFILIATES, THIRD PARTIES RELATED TO THE COMPANY, PARTNERS, SUBSIDIARIES) COMPANY IS NOT LIABLE FOR ANY INDIRECT, DIRECT, CONSEQUENTIAL, SPECIAL OR INCIDENTAL OR OTHER DAMAGES RESULTING FROM, ARISING OUT OF OR IN CONNECTION WITH THE- ACCESS, USE OF, OR INABILITY TO ACCESS OR USE THIS APP, THE APP OR AN ACTION OCCURRED FOLLOWING THE USE OF THE APP, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES INCLUDING DAMAGES ARISE AS A RESULT OF THE COMPANY OR ANY OTHER MISUSE OF THIRD PARTY OF THE APP, AS AN EXAMPLE BUT NOT ONLY- CYBER-ATTACK OR HACKING ATTACK BUT NOT ONLY. THE APP IS PROVIDED AS-IS BASIS AND AS AVAILABLE, WITHOUT WARRANTY OF ANY KIND. NO GUARANTEE THE APP WILL WORK WITH NO FAULTS OF ANY KIND.
The app is not a must-have feature and not must be downloaded in order to operate a company home appliance. You take full responsibility for the use of the app and its effects including, without limitation, the accuracy or sensitivity of the app, features, distance of control, minimal requirements such as operating system or Wi-Fi or internet speed, or full sync with a specific product. The company takes caution with protecting the app from hacking attempts from third parties, but the company can't assure that. If you have appliance that can cause damage from the activity of misuse or abuse of the app, please don’t download the app or erase it.
The company has the right to show coreciales and change any content of the app of app behavior\functionality.
Your only remedy from the terms of use will be limited to correcting, according to company goodwill, such errors or malfunctions, and in light of the relevant circumstances.
Permissions
Access confirmation:
In registering for the app services, the user gives access to storage space, the camera, and the location of the device.
Using GPS, phone identity and identity. The application may allow, subject to the features of the device in use.
User, activation of location services. A user who approves the activation of the location services in relation to the application than in this HIGOAL-Group can use the location to identify the Wi-Fi network to which the phone is connected. It is known to the user that impairment of the quality of location detection may have an effect on the experience of using the application and/or prevent its proper operation.
Access to location services enables location-based activation that the user can create.
Access to the camera is used by the user to take a picture to the room, the picture is breathed on the user's phone and at his own risk. The image is not saved on the HIGOAL-Group servers.
Access to storage on the phone is used by the user to save photos he took to add a photo from a gallery as the main photo to the room.
However, after confirming the use of location data, you can execute location-based commands and scenarios.
You will be able to perform weather-based scenarios based on meteorological data in the project area.
Wi-Fi device configuration and other functions require location permissions.
HIGOAL does not collect and store any user location information.
Registration and user account
Users will be asked to fill up details during the sign-up process. In order to able the company the best service please fill correct all required fields. The ENERGY information is only an estimate.
For your safety company may send you an SMS of notification the reconfirm your sign-up. The app is for personal use and isn’t transferable.
The company takes reasonable actions to secure the use of the users and profile app goals. The company may change/erase/close/suspend accounts or take any other action. For example but not only the infringement of the terms of use, unreasonable use of the app, use of a third party of the, etc.
For user safety please keep the user name and password in a secret place.
The company will use the app regarding the privacy policy and terms of use.
Commercials
The company will have the right to show commercials on the app.
Intellectual property rights
All applicable marks and logos, Copyrights, trademarks, industrial designs, patents, and trade secrets belong to the company either signed rights or by law. The protection is on (but not only) regarding UX, design, content, text, code, process, technology etc.
The users don’t have the right to company's assets without company written confirmation such as copy or modify, adapt, translate, reverse engineer on any part of the app or company products or services or violating any third party or other user's right to privacy or other rights.
Any infringement of the company's rights can cause legal procedures according to the law.
Jurisdiction
The use of this app will be governed by the laws of the state of Israel, excluding its conflicts of laws principles. Any disputes with connection to the app will be brought only to the competent court in Tel Aviv, Israel, and both parties consent to the personal jurisdiction and the venue of that court.
Changes to the Terms
We may change the Terms. You agree to review the Terms from time to time so be updated of any modifications. Your use of the Service thereafter or by keeping the app indicates your acceptance of the updated Terms.
